- ACCEPTANCE OF TERMS
SHINE POWER Inc. (“SHINE POWER”) provides the www.myshinepower.com website (along with any other website or mobile application SHINE POWER may offer now or in the future, collectively, the “Site”), all information, content on the Site (collectively, the “Content”), all services available through the Site (collectively, the “Services”) and all products that may be purchased through the Site (collectively, the “Products”) pursuant to the terms and conditions set forth below and the terms and conditions incorporated herein by reference (collectively, the “User Agreement”), which is a legally binding agreement between you and SHINE POWER.
PLEASE READ THIS USER AGREEMENT CAREFULLY. BY ACCESSING OR USING THE SITE OR THE SERVICES YOU AGREE TO BE BOUND BY THIS USER AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS, PLEASE DO NOT ACCESS OR USE THE SITE OR THE SERVICES. THIS USER AGREEMENT WAS LAST UPDATED ON 04/11/2024.
- AMENDMENTS TO THE USER AGREEMENT
SHINE POWER may update this User Agreement periodically. You will be required to accept the updated User Agreement with any amendments made since your last acceptance. The most current User Agreement will always be available for review on the Site. Continued use of the Site after an updated User Agreement has been posted constitutes acceptance of the modified User Agreement.
- DESCRIPTION OF SITE AND SERVICES
SHINE POWER offers a premier online platform under the guidance of renowned experts, allowing you to purchase skincare products, beauty products, and other Products, and offers information relating to skincare and beauty products and related Services. SHINE POWER reserves the right to modify, suspend, or discontinue any aspect of the Content, Services, or Products at its discretion.
- REGISTRATION; GUEST ACCOUNT ACCESS
Certain Services require registration. Services are not available to minors; you must be 18 years or older to register. SHINE POWER reserves the right to refuse service or registration to anyone at any time. By registering, you agree to provide true and accurate information and to maintain the accuracy of this information.
- PRIVACY POLICY
Your information provided to SHINE POWER through the Site or Services will be treated in compliance with SHINE POWER’s Privacy Policy, which is incorporated into this User Agreement.
- CONTENT ON SITE
The Site and its Content remain the sole property of SHINE POWER. You are granted a limited license to access and use the Site and its Content for personal, non-commercial purposes.
- SOFTWARE APPLICATIONS
Any Software provided through the Site is subject to the terms of the end-user license accompanying the Software. You are granted a personal, non-transferable license to use the Software for its intended purpose.
- CONDUCT
You agree to follow basic rules of conduct when using the Site and/or Services, including complying with all applicable laws, maintaining the confidentiality of your account information, and not engaging in prohibited activities such as harassment or the transmission of harmful code.
- FEEDBACK BY USERS
By submitting any feedback or suggestions to SHINE POWER, you grant SHINE POWER a non-exclusive, worldwide, royalty-free license to use your feedback in any manner it deems appropriate.
- INTELLECTUAL PROPERTY INFRINGEMENT CLAIMS
If you believe that any Content on the Site infringes upon your intellectual property rights, you should provide detailed information to SHINE POWER’s designated agent for such claims.
- THIRD-PARTY ADVERTISERS AND LINKS
SHINE POWER is not responsible for the content or practices of third-party websites linked to or from the Site. Interactions with third-party advertisers or participation in promotions are solely between you and the third party.
- SALE OF PRODUCTS
Purchases of Products through the Site are subject to this User Agreement and any additional terms listed on the Product’s listing. SHINE POWER attempts to accurately describe and display Products but does not warrant that descriptions or other content are accurate, complete, or error-free.
- INDEMNITY
You agree to indemnify and hold harmless SHINE POWER and its affiliates from any claims, damages, or expenses arising from your use of the Site, Services, or Software, or your violation of this User Agreement.
- WARRANTY DISCLAIMERS
The Site, Services, and Software are provided “as is” without warranties of any kind. SHINE POWER disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
- LIMITATION OF LIABILITY
SHINE POWER’s liability to you for any cause will be limited to the amount paid by you to SHINE POWER in the 12 months prior to the action giving rise to liability. SHINE POWER is not liable for indirect, incidental, special, consequential, or exemplary damages.
- EXCLUSIONS AND LIMITATIONS; CONSUMER PROTECTION NOTICE
Some jurisdictions do not allow certain warranty exclusions or limitations on liability. Therefore, some exclusions and limitations in this User Agreement may not apply to you.
- ACCESS TO SERVICES; RESALE OF PRODUCTS
The Services are intended for personal use only. You agree not to resell Products purchased through the Site.
- REWARDS PROGRAM
SHINE POWER may offer a rewards program subject to change at any time. Participation in the rewards program is subject to the program’s terms and conditions.
- Auto-Replenish Program
By subscribing to the Auto-Replenish program, you agree to the terms and conditions of SHINE POWER’s Auto-Replenish program and authorize recurring charges for subscription orders.
- SMS Messaging Terms & Conditions
By opting into SHINE POWER’s SMS messaging services, you agree to receive mobile alerts about sales, promotional events, and other offers. You may opt out at any time by texting STOP.
- CHOICE OF LAW AND FORUM
This User Agreement is governed by the laws of the State of New York. Disputes arising from or related to this User Agreement shall be resolved in the state courts of New York.
- GENERAL TERMS
This User Agreement constitutes the entire agreement between you and SHINE POWER. SHINE POWER may give notice to you via email, regular mail, or postings on the Site.
